TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of the Stummy™ mobile application, the website at stummy.io, and any related services (collectively, the "Service"), provided by the developer of Stummy ("Developer," "we," "us," "our"). Full details about who operates Stummy are in the About the Developer section near the end of these Terms.
By downloading, installing, registering for, or otherwise using the Service, you agree to be legally bound by these Terms and by our Privacy Policy, incorporated here by reference. If you do not agree, do not use the Service.
1. Description of the Service
The Service provides digital wellness tools to help users understand food and FODMAP content, track digestive symptoms, and plan meals, including: barcode/image food scanning, ingredient analysis, digestive symptom tracking, automated dietary insights, meal planning, shopping lists, and educational content on digestive health and nutrition.
The Service is a wellness and lifestyle support tool. It is not a medical device, healthcare service, or diagnostic tool, and does not provide medical advice. See Section 2 below.
We may modify, suspend, or discontinue any part of the Service at any time.
2. Medical Disclaimer, Assumption of Risk, and Allergy Warning
PLEASE READ THIS SECTION CAREFULLY. IT LIMITS OUR RESPONSIBILITY TO YOU.
2.1 No medical advice. Stummy provides information related to digestive health conditions such as IBS, SIBO, and food sensitivities for informational and educational purposes only. It does not provide medical advice, diagnosis, or treatment, and is not a substitute for consulting a licensed physician, gastroenterologist, or registered dietitian. You must consult a qualified healthcare professional before making any decision related to your diet, medication, treatment, or health condition, and especially before starting, changing, or stopping any diet, including a Low FODMAP or elimination protocol. Never disregard or delay seeking professional medical advice because of something you read or saw in the Service. If you believe you are experiencing a medical emergency, contact emergency services immediately.
2.2 Not an allergen safety tool. Stummy's ingredient and FODMAP data is not designed or validated to detect food allergens and must not be relied on by anyone with a food allergy, intolerance requiring medical management, celiac disease, or any other condition where an incorrect ingredient reading could cause serious harm. If you have a diagnosed allergy or a condition where exposure to a specific ingredient could be dangerous, always verify ingredients directly from the product packaging or manufacturer, and do not rely on Stummy's scan results as your sole safety check.
2.3 AI and data limitations. Automated/AI-generated outputs (Section 6) and ingredient data (Section 7) may be inaccurate, incomplete, or out of date. You are solely responsible for verifying any information before acting on it.
2.4 Assumption of risk. By using the Service, you knowingly and voluntarily assume all risks arising from your reliance on any content, insight, meal plan, or ingredient/FODMAP data provided through it, including risks to your health, diet, or well-being. You remain solely responsible for all decisions about your diet, nutrition, and health.
2.5 Individual results vary. We make no representation or warranty that using the Service will improve your symptoms or health outcomes.
3. Eligibility
You must be at least 16 years old to use the Service. The Service is not directed at, and may not be used by, anyone under 16 — there is no parental-consent pathway for younger users, because the Service processes health-related information that requires this stricter age floor. By using the Service you represent that you meet this requirement, have the legal capacity to enter into these Terms, and that any information you provide is accurate and complete. We may suspend or terminate accounts that do not meet these requirements.
4. Accounts (Not Currently Offered)
Stummy does not currently require or offer user account creation — there is no email/password login or sign-in, and the Service is used without registering. If we introduce optional accounts in the future (for example, to sync data across devices), that feature will be governed by additional terms we present at that time, including your responsibility for keeping any credentials confidential and notifying us immediately at support@stummy.io of unauthorized access. We may suspend or block access to the Service (by device or purchase identifier) for violations of these Terms or fraudulent or unauthorized activity.
5. Acceptable Use
You agree not to: violate any applicable law; use the Service for unlawful, harmful, or fraudulent purposes; attempt unauthorized access to the Service or other accounts; interfere with the Service's operation or security; upload harmful, illegal, defamatory, or misleading content; distribute malware; reverse-engineer, decompile, or disassemble the Service; or scrape or bulk-collect data from the Service (including our food/FODMAP database) without our written permission. Violations may result in suspension or termination.
6. Artificial Intelligence and Automated Analysis
Certain features use third-party AI systems — OpenAI, Google, and AIProxy (a secure proxy that routes AI calls without exposing API keys) — to analyze food images, barcodes, packaging text, ingredients, dietary patterns, and symptom logs you submit. You acknowledge that: automated analysis may contain inaccuracies; outputs depend on the quality of what you submit; and automated systems cannot account for every health variable. Outputs are informational insights only and must never be treated as medical advice (Section 2).
7. Data Accuracy and Ingredient Information
Ingredient and FODMAP information may come from public nutrition databases, manufacturer data, third-party ingredient databases, and automated recognition systems (Section 6). Formulations can change without notice and vary by region or batch. We do not guarantee the accuracy, completeness, or currency of any ingredient or FODMAP information. Always verify against product packaging before making a dietary decision — see the Allergy Disclaimer in Section 2.2.
8. Dietary Protocols and Nutrition Information
The Service may reference dietary protocols such as the Low FODMAP diet and elimination diets, provided solely for informational purposes. Individual responses to dietary changes vary significantly, and these protocols are not appropriate for everyone. Consult a healthcare professional or registered dietitian before implementing any dietary change, particularly if you have a diagnosed digestive, metabolic, or other medical condition, are pregnant or breastfeeding, or are otherwise under medical care.
9. Subscriptions and Payments
Certain features require a paid subscription, billed through the Apple App Store and managed via RevenueCat. Prices are shown before purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period; manage or cancel your subscription in your Apple ID account settings. Refunds are governed solely by Apple's standard refund policy — we do not process refunds directly and have no ability to override Apple's decisions. We may modify subscription pricing, billing structure, or included features at any time, with notice as required by Apple's guidelines and applicable law.
10. User Content
You may submit content such as food logs, symptom records, dietary notes, and feedback. You retain ownership of your content. By submitting it, you grant the Developer a non-exclusive, worldwide, royalty-free license to store, process, analyze, and display it solely to operate, improve, and develop the Service (including sending it to the AI providers named in Section 6 for the purpose of generating your results).
11. Intellectual Property
All intellectual property in the Service — software, design, branding, content, the ingredient/FODMAP database, algorithms, and functionality — belongs to the Developer or their licensors. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, or publicly display any part of the Service without prior written permission.
12. Third-Party Services
The Service integrates with the providers named in Section 6 and Section 9, plus Firebase and Amplitude (in-app analytics) and Vercel (website hosting and analytics for stummy.io). Your use of those services is governed by their own terms and privacy policies, and we are not responsible for their practices.
13. Service Availability
We aim for reliable operation but do not guarantee the Service will be uninterrupted, available, or error-free. It may be unavailable due to maintenance, technical issues, network problems, or circumstances beyond our control.
14. Updates and Modifications
We may update, modify, suspend, or discontinue any part of the Service, and may update these Terms, at any time. Material changes will be posted within the Service or on our website, with the "Last Updated" date revised. Continued use after changes take effect constitutes acceptance of the revised Terms.
15. Suspension, Termination, and Account Deletion
We may suspend or terminate your access if you violate these Terms, pose a security risk, or as required by law. You may stop using the Service, and delete your locally stored data, at any time directly on your device (see our Privacy Policy, Section 17). Upon termination, your access may be disabled and any data we hold through our third-party providers handled per our Privacy Policy.
16. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, we disclaim all warranties regarding uninterrupted or error-free operation, the accuracy or completeness of ingredient/FODMAP/AI-generated data, and any effect (or lack of effect) the Service may have on your symptoms or health.
17. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:
(a) The Developer shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of health, loss of data, or loss of profits, arising out of or relating to your use of, or inability to use, the Service, even if advised of the possibility of such damages.
(b) The Developer's total aggregate liability for any claim arising from or relating to these Terms or the Service — under any theory of liability — shall not exceed the greater of (i) the amount you paid the Developer for the Service in the 12 months preceding the claim, or (ii) USD 50.
(c) These limitations apply to the maximum extent the law allows. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law — including, where applicable, liability for death or personal injury caused by negligence, fraud, or gross negligence, or statutory consumer rights that cannot be waived. Where such mandatory rights apply, this Section 17 applies to the fullest extent still permitted.
18. Indemnification
You agree to indemnify, defend, and hold harmless the Developer, personally, from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: your use of the Service; your reliance on any content, insight, or data provided through it; your violation of these Terms; or your violation of any law or third-party right. This indemnity survives termination of these Terms.
19. No Class Actions
To the extent permitted by applicable law, you agree to bring any claim against the Developer only in your individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. Where mandatory law in your jurisdiction does not permit this waiver, this Section does not apply to you, and Section 20 governs instead.
20. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Cyprus, without regard to conflict-of-law principles, and any dispute shall be subject to the exclusive jurisdiction of the courts of Cyprus, except where mandatory local consumer-protection law gives you the right to bring a claim in the courts of your own country of residence — in which case that mandatory right is not affected by this Section. This choice of law does not deprive you of the protection of any mandatory provisions of the law of your country of habitual residence, where applicable (e.g., for EU/UK/US consumers).
21. Export Compliance
You agree to comply with all applicable export control laws and regulations in your use of the Service.
22. Force Majeure
The Developer is not liable for delays or failures caused by events beyond reasonable control, including natural disasters, internet or infrastructure outages, government action, or pandemics.
23. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision will be interpreted to best reflect its original intent within the limits of applicable law.
24. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Developer regarding the Service, superseding any prior agreements on this subject.
25. About the Developer
Stummy is developed and operated by Artem Voloshanenko, an individual based in Cyprus, registered with the Apple App Store as an individual developer, rather than through a separate company. "Stummy" is his trading name, and "we," "us," "our," and "the Developer" throughout these Terms refer to him personally.
